RPM in Switzerland
In the opinion of the Swiss Federal Supreme Court in Lausanne, retail price maintenance on books constitutes an inadmissible restraint of competition. These were the grounds for dismissal of the appeal of the Swiss Association of Book Traders and Publishers (SBVV) and the Association of the German Book Trade (BB) against a likewise negative ruling of the Swiss Federal Competition Commission. The judgement has no direct impact on retail price maintenance in Germany and Austria, stated the BB. Even if publishers export from the two EU Member States to Switzerland, they can continue to fix a trade price and a separate retail price. They are, indeed, obliged to do so under their respective national laws. Their Swiss colleagues must adhere to these specified prices. Roughly 80 percent of the book market in Switzerland is based on imports from Germany.
